Online Silent Auction Rules

  • Each silent auction item indicates the terms, estimated retail value, starting bid amount and the minimum bid increment.
  • The item’s estimated retail value is given, where possible. When an item’s value is subjective, such as an autographed item, the value is deemed “priceless” or “variable”.
  • Silent auction items are awarded to the highest bidder(s) at the time of closing of the online silent auction.
  • All bids must be placed online. Subsequent bids must exceed the last bid by at least the minimum bid increment amount.
  • Bid cannot be entered for someone other than yourself.
  • Payment in full is required to receive your silent auction item.  Checks and credit cards are accepted. Please make any checks out to the Anxiety & Depression Initiative (or the ADI) and mail it promptly to PO Box 126, Little Falls, NJ 07424, upon notification that you are the winner.
  • All sales are final and items are sold “as is”. The bidder is responsible for carefully reading any terms, specifications or limitations associated with the items that they are bidding on.
  • There will be no exchange or refund of any item by either the Anxiety & Depression Initiative, or the item donor.
  • The Anxiety & Depression Initiative is not responsible for auction items not redeemed by the date specified by the donor. Please take note of any restrictions, deadlines or expiration dates as you are bidding.
  • Unless otherwise specified, all items or services must be used, or redeemed, by October 20th, 2018.
  • Non-tangible auction items will be supplied as gift certificates with any needed accompanying information, if applicable.
  • All items will be mailed to the verified winner after payment for the item.
  • Federal and state laws govern the extent to which auction items can be deducted for tax purposes. Please consult your tax advisor to determine how this applies to you.
  • By accepting, redeeming or using a prize, all participants, their successors and assigns, hereby release the Anxiety & Depression Initiative and its subsidiaries, affiliates, employees, volunteers, officers, representatives directors and agents (collectively “Released Parties”), agree to indemnify the Released Parties and Donors and hold them harmless from any and all liability and damages, including consequential damages, whether arising from personal injury or otherwise, and resulting in whole or in part, or directly or indirectly, from acceptance, possession, use or misuse of any prize or redeemed at this auction.
  • Participants also acknowledge that auction items have been furnished through the generous contributions of donors (not the Anxiety & Depression Initiative) and that the Released Parties have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee, whether expressed or implied, in fact or in law, relating to the prizes, including but not limited to, their quality, condition or fitness for any particular purpose or use.
